LatinoJustice PRLDEF Cada Voto Cuenta Mobile Application Privacy Policy

(Effective Date: August 29, 2016)

Summary

Welcome to the LatinoJustice PRLDEF Cada Voto Cuenta mobile application (the “Application”), which is designed to accept reports of violations of voter rights in the states of Florida, Georgia, and New York, as well as alert users of the Application when a nearby user may be reporting such violations.  We may use submitted reports and associated information to increase public awareness of and monitor violations of voter rights in the states of Florida, Georgia, and New York.

Scope

LatinoJustice PRLDEF, Inc., a nonprofit 501(c)(3) organization, and its officers, directors, agents, representatives, assigns, subsidiaries, joint ventures, and employees (“LatinoJustice PRLDEF”, “we”, “us” or “our”) are committed to protecting Your privacy.  This privacy policy (the “Privacy Policy”) articulates the principles, actions and beliefs of with regard to the information collected, retained and used through our Cada Voto Cuenta mobile application ("the Application”) from You (“You”, “Your”, “Yours”), as a user of the Application.  This Privacy Policy is entered into by and between You and LatinoJustice PRLDEF.  This Privacy Policy (together with our Terms & Conditions of Use) is presented to You in order to help You make an informed decision about using the Application (including updates, documentation and all content and services provided by or through the Application) and to explain to You what information we collect, how we store that information, and how we may use it. 

By using this Application, You acknowledge and agree to this Privacy Policy, and You are consenting to have Your personally and non-personally identifiable data transferred to and/or processed in the United States in accordance with the terms of this Privacy Policy.  Please do not use the Application if You do not agree with this Privacy Policy, the Terms & Conditions of Use, or any other Policies listed on LatinoJustice PRLDEF’s website here (the “LatinoJustice PRLDEF Site”).

A.        The Information We Collect from You

1.         Non-Personally Identifiable Information

When You download and use the Application, we may collect certain non-personally identifiable information. This may include information about Your mobile device’s (the “Mobile Device”) operating system, and demographic information (including age and gender).  We may use this non-personally identifiable information to help understand trends in our user population, as well as diagnose problems with our servers and for other administrative purposes.

In addition, we may also collect aggregate traffic information through Your use of the Application.  We may use this data for improving the services we offer through the Application.

2.         Personally Identifiable Information

We do not access, collect or retain any information, including cookies, device IDs, or activity information about Your use of other applications or websites, other than what is specifically set forth here.  In order to contact You about any content You send to us through the Application, including (as defined below) Video Reports, Written Reports, and Witness Reports (collectively, the “Content”), we must have certain information about You.  Therefore, from time to time, You will be asked to submit personal information about Yourself. We request, collect and process the following personally identifiable information related to Your use of the Application (the “Registration Information”), which we may use to contact You about any Content You submit:

·      Name

·      Email

·      Address

·      Phone Number

·      Information about Your Mobile Device and Internet connection: Your IP address may be included in the transmission of information to LatinoJustice PRLDEF, but we do not retain Your IP address after processing that information.

In addition, You may voluntarily choose to provide the following personally identifiable information in connection with Your use of the Application:

·      Your geolocation data (by opting in to the Application’s collection of this data through the Witness or Location of Polling Place/Incident feature)

·      Government Identification Numbers (including Social Security Number, Driver’s License Number, Passport Number)

·      Information about Your Polling Place (location, hours, description of the personnel operating the Polling Place)

·      Time of alleged violations of voter rights

·      Video or audio submissions of alleged violations of voter rights (“Video Reports”)

·      Written submissions of alleged violations of voter rights (“Written Reports”)

·      Witness reports of alleged violations of voter rights (“Witness Reports”)

3.         Privacy of Children and Sensitive Consumer Information

LatinoJustice PRLDEF does not knowingly collect information from anyone under the age of 13.

If we are made aware that we have received information from anyone under the age of 13 in violation of this Privacy Policy, we will use reasonable efforts to locate and remove that information from our records.

B.        Use of Information Collected

1.         Primary Purpose

The information and data collected by the Application is primarily for the purposes of:

·      Reviewing alleged instances violations of voter rights;

·      In certain instances, at LatinoJustice PRLDEF’s sole discretion, providing legal representation to users who document alleged violations of voter rights;

·      Obtaining evidence of alleged violations of voter rights that may be used in LatinoJustice PRLDEF’s sole discretion in reports, advocacy pieces, lawsuits, or for any other use;

·      Ensuring that content and services from our Application is presented to You in the most effective manner for You and Your Mobile Device;

·      Providing You the services You request;

·      Notifying You about changes to our service and policies; and

·      Responding to Your user support inquiries.

 

2.         Our Use of the Content You Submit through the Application

 

(a) Written Reports and Witness Reports

We review the information You provide in Written Reports and Witness Reports, and we treat those Reports as requests for legal assistance that are protected by the attorney-client privilege.  Neither the Application nor any of the materials in it are solicitations or offers by LatinoJustice PRLDEF to represent You.  We cannot promise You that the information You provide will lead to any specific action on the part of LatinoJustice PRLDEF. 

We also may use the information You give us in Written Reports or Witness Reports (without Your Registration Information or any other information we believe may identify You) for one of the following purposes: (i) to further the purposes of the Application, including as legislative testimony; (ii) in support of litigation; (iii) in communications with a city, state or federal agency; or (iv) to tell Your story to the public, including through the media.

(b) Witness Reports

We may review Video Reports whether or not they are accompanied by a Written Report.

Because Witness Reports are intended to convey information about an incident to which You were a witness, and not a subject, we do not treat Witness Reports as confidential. Do not send use the Witness Reports feature for any communications You intend to be confidential. Before submitting a Witness Report containing the personal information of another individual, confirm that You have the individual’s consent to do so.

We may use the information You give us in Witness Reports to contact the subject of a Witness Report about taking potential legal action based on the Content of the Witness Report. We may also use the information You give us in Witness Reports (without the Registration Information of the subject of the Witness Report) for one of the following purposes: (i) to further the purposes of the Application, including as legislative testimony; (ii) in support of litigation; (iii) in communications with a city, state or federal agency; or (iv) to tell the individual’s story to the public, including through the media.

(c) Video Reports

We may review Video Reports whether or not they are accompanied by a Written Report or a Witness Report.

Because Video Reports are intended to contain documentary evidence rather than any communication, we do not treat Video Reports as confidential. Do not send or use the Video Reports feature to make video recordings of any communications You intend to be confidential. Before submitting a Video Report containing footage and/or the personal information of another individual, confirm that You have the individual’s consent to do so.

As described below, we may share or disclose part or all of the Video Reports You give us to any person or organization, or directly to the general public, if we believe such a disclosure would further the Application’s purpose and LatinoJustice PRLDEF’s mission of protecting civil rights and civil liberties.

(d) Geo-Location Information

We may use Your Geo-location Information to track and respond to Written Reports, Witness Reports, and Video Reports. If You opt into the App’s Witness feature, we will alert other users nearby when You submit a Report and will provide them with Your Geo-location information at the time You submit the report. We will not provide them with any other information, including Your Registration Information, or any information from Your Written Report or Video Report. We will also send You a notification if a nearby user has submitted a Report using the App.

3.         Contact

We may periodically contact You using information supplied to us through the Application, for example, in response to a Video Report, Written Report, or Witness Report You may have submitted, or to inform You about initiatives LatinoJustice PRLDEF has undertaken that may be of interest to You. We may contact You via RSS notification, email, or via phone. You may opt out of receiving certain email communications by clicking on the “unsubscribe” link at the bottom of such emails. You may opt out of receiving RSS notifications by changing the Application settings or Your mobile device settings.

Certain communications, such as those regarding changes to our policies or changes to services You have opted into, You may not opt out of. 

C.        Disclosure of Your Personal Information

We do not sell Your personally identifiable information, and we will never sell Your personally identifiable information to any person, company, or other third party. 

1.         Service Providers

We may employ service providers and other companies and individuals to perform functions and provide services on our behalf (such as email service, and account management).  These entities may have access to Your personal information to the extent needed to perform their functions and also to provide You with the services that You have requested.  Our service providers agree not to use or disclose Your information, and will only use Your information to provide service to us or to comply with legal process.

2.         Compliance with Law

LatinoJustice PRLDEF reserves the right to disclose Your personal information, without prior notice to You, as required by law or when we believe that disclosure is necessary to comply with a law, regulation, or any legal request (e.g. court order or subpoena) served on the Application or LatinoJustice PRLDEF Site.  Furthermore, we may share Your personal information when we believe it is necessary to address fraud or other illegal or prohibited activity perpetrated through LatinoJustice PRLDEF’s Application or Site or to prevent imminent bodily harm.  However, nothing in this Privacy Policy is intended to limit any legal defenses or objections that You may have to a third party’s, including a government’s, request to disclose Your information. 

3.         Other Application Users

If you opt-in to the Applications’s Witness feature, when you submit a Report we may disclose your Geo-location Information, but not your Registration Information or any other information we think could identify you (such as your name, postal or email address, phone number), to others who have downloaded this Application and have opted into the Witness feature.

4.         The Broader Public Without Identifying Information

We may disclose your Video Reports or information from your Written Reports or Witness Reports (including the location of an incident you reported), but not your Registration Information or any other information that we think might reasonably identify you, to anyone where we believe such a disclosure would further the Application’s purpose and LatinoJustice PRLDEF’s mission, of protecting voter rights, including, but not limited to:

·      News organizations and other members of the media;

·      Courts, legislators, law enforcement agencies and other governmental officials;

·      Partner organizations working to protect civil rights, civil liberties, or human rights; or

·      Directly to the public through our web site or other materials.

Under no circumstances will we disclose information that we think might reasonably identify you to the broader public.

5.         In an Emergency

We may disclose Your information in certain emergency circumstances, including where we believe doing so is necessary to prevent imminent and serious bodily harm to a person.

D.        Changing or Deleting Your Information

If You are a registered user, You may review, update, correct or delete the personal information provided in Your account registration by visiting “Settings.” If Your personally identifiable information changes, or if You no longer desire to use our services, You may update Your personal information or unregister through the account settings page. In some cases, we may retain copies of Your information if required by law. For questions about Your personal information, please email us

E.         Mobile Device Choices

We do not collect unique mobile device identifiers from users of the Application for the purpose of delivering targeted advertising. However, when You visit a website outside of the Application or LatinoJustice PRLDEF Site, some third parties may collect and use Your unique mobile device identifier to deliver custom advertising to Your Mobile Device. F.         Security

We have implemented reasonable measures to protect the information we collect and store, taking into consideration the types of risks we face and the reasonable protections available to us.  All information You submit will be transmitted only via secure connection (SSL).  No method of protecting information is 100% secure, and we cannot guarantee its absolute security.

G.        Information for Users Outside the United States

The use of this Application or visiting LatinoJustice PRLDEF Site from outside the United States is prohibited. Please be aware that information we collect through the Application and our Site will be transferred to and stored on our servers in the United States. By using the Application and LatinoJustice PRLDEF Site, You acknowledge and consent to the transfer and processing of Your non-personally identifiable information and personally identifiable information in the United States as described in this Privacy Policy. Please be aware that the data protection laws and regulations applicable to Your non-personally identifiable information and personally identifiable information transferred to the United States may be different from the laws in Your country of residence.

H.        Your California Privacy Rights

California law permits customers in California to request certain details about how their information is shared with third parties and, in some cases, affiliates, when the information is shared for those third parties’ and affiliates’ own direct marketing purposes. Under the law, a business must either provide this information or permit California customers to opt in to, or opt out of, this type of sharing.

We do not share certain information about You collected by us through the Application or the LatinoJustice PRLDEF Site with third parties or affiliates for those third parties’ or affiliates’ own marketing purposes.

I.          Privacy Practices of Third Parties

When You click on links to website outside of the Application or the LatinoJustice PRLDEF Site, third parties may place their own cookies or other technological devices on Your Internet browser.  We have no control over these third parties and no responsibility for the technologies they employ.  To learn how a particular web site collects and uses Your information, You should read the privacy policy of that website.

J.         Changes to Privacy Policy

We may modify this Privacy Policy at any time, so please review it frequently and at least each time You submit personal information through the Application or to the LatinoJustice PRLDEF Site. If we make material changes to this policy, we will notify You here at www.latinojustice.org/cadavotocuenta/privacy, by email, or by means of a notice on our homepage. The date of the most recent revisions will also appear on this page. Changes are effective immediately upon posting. Unless stated otherwise, our current Privacy Policy applies to all information that we have about You and Your interactions with the Application or the LatinoJustice PRLDEF Site.
